Please read them carefully before making a purchase. If you do not agree with any part of these policies, please do not purchase our products or visit our website. We reserve the right to modify these policies at any time, so please check back periodically for changes. 

We respect privacy and your rights to control your personal data. This Privacy Policy (the “Privacy Policy”) applies to information that we collect through our websites, mobile applications, and connected products and services (collectively, the "Websites"), in our stores, at events, and through our customer service channels. This Privacy Policy describes the personal data we collect, and explains why we collect it, how we use it, and when we share it with third parties. Our Privacy Policy also describes the choices you can make about how we collect and use your personal data.

How we collect personal data from you

We may collect your personal data in a number of ways and for various purposes. You may provide us with personal data when you make an online purchase or create an account on our Websites, in person, when you sign up to receive promotional emails, texts, and other communications from Barbee’s Baubles, LLC, and when you enable, engage with, log into, or sign on to Barbee’s Baubles social media websites such as Facebook, Instagram, or YouTube (“Social Networking Services” or “SNS”). When you connect using your SNS accounts, we may collect personal data that you have provided to that SNS. For example, when you log in with your Facebook/Meta credentials, with your consent, we may collect personal data from your Facebook/Meta profile that is permitted under Facebook’s Terms of Use – such as your email address, profile picture, and friend list. We use this data to provide, enhance, and personalize the services we provide to you. If you do not want us to provide us with this information, please change the privacy settings on your SNS account.
 
Cookies are files that contain information about your general Internet usage and are stored on the hard drive of your device. From these cookies, we may collect information about your browser, including your IP address, operating system and browser type, for system administration. Cookies help us to improve our Websites and to deliver a better and more customized service. They enable us to estimate usage numbers and patterns, store information about your preferences, customize our Websites according to your individual interests, speed up your searches, and recognize you when you return to our Websites.
 
You have the right to refuse to accept cookies by activating the setting on your browser that allows you to refuse the setting of cookies. How we use, store, and disclose your personal data and personal information

We use and store the information we collect from our customers for various purposes, including to:

  • Improve our Websites, events, customers shopping experience, and quality of service;

We collect Personal Information directly from you, your device, and/or your browser, and SSN through means described above.We collect and disclose your identifiers and non-public Personal Information to service providers and third parties that assist with our business operations and order execution such as those who process payments and shipping companies who deliver packages to you. We collect the following categories of Personal Information about you for the following purposes:

If you have provided personal data to us through more than one method, we may combine such information for the purposes identified above.
 
We will not provide your information to any other entity or person with the following exceptions: 

  • For purposes of processing payment to fulfill your order

  • For purposes of shipping/delivery to fulfill your order

  • we are legally required to do so in order to cooperate with:

    • To comply with legal proceedings, law enforcement, court orders, laws, regulations, or other legal obligations, or for crime-prevention or fraud-prevention purposes

    • To assist in an investigation (e.g., fraud)

    • To protect and defend our rights and property, or the rights or safety of third parties used to fulfil your orders (i.e., billing and shipping/delivery vendors)

    • To enforce our Terms of Use, this Privacy Policy, or agreements with third parties (i.e., billing/shipping vendors)

    • To protect against misuse or unauthorized use of our Websites.

 
We will not sell your personal data to any third party for monetary consideration. However, any and all personal information we collect may be given to another company in the event of a sale, merger, or other acquisition of some or all of our assets or business or as part of the negotiation or evaluation of such sale, merger, or other acquisition.
 
Our Websites may include links to third party websites whose privacy practices may differ from ours. If you provide personal data to any of those third parties, it will be governed by their privacy policies, and we encourage you to read those privacy policies carefully before providing your personal data.
 
We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the Applicable State Privacy Laws (i.e., California, Colorado, Connecticut, Utah, and Virginia residents, collectively, the “Applicable States”). If you are a resident of any of the Applicable States, you have the right to submit certain requests relating to your Personal Information or Personal Data as described below. To exercise any of these rights, please submit a request to us via email at info@barbeesbaubles.com.  Authorized agent requests must include a copy of the agency agreement between the authorized agent and the consumer. We will ask the consumer to independently confirm the agency relationship. Any request you submit to us is subject to an identification verification process (“Verifiable Request”). This verification process includes providing us at least two (2) unique data points, depending on the type of request. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the Consumer about whom we collected Personal Information or Personal Data. We will typically not charge a fee to fully respond to your requests, but we may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.

 

Retention of personal data

Barbee’s Baubles, LLC will retain your personal data only for as long as necessary for the purposes it was retained, such as to enable you to use the Websites and your products or to provide services to you. In some instances, we may retain data for longer periods in order to comply with applicable laws (including those regarding document retention), resolve disputes with any parties, and otherwise as necessary to allow us to conduct our business. All personal data we retain will be subject to this Privacy Policy and our internal retention guidelines.

Right to know

We do not use or disclose your sensitive Personal Information to infer characteristics or for other purposes subject to limitation under Applicable States’ laws.  Accordingly, there is no need for you to direct us to limit the use and disclosure of your sensitive Personal Information. We will only use or disclose sensitive Personal Information in a manner that is reasonably necessary as listed in the Table above. If you choose to exercise any of your privacy rights under Applicable States’ laws you also have the right not to receive discriminatory treatment by us.
 

  1. Right to Access. You have the right to request access to and obtain a transportable copy of any Personal Data that we may hold about you. You have the right to receive the personal data that you have provided to us, in a structured, commonly used and machine-readable format, and you have the right to transmit that information to another controller, including to have it transmitted directly, where technically feasible. Your right to know request may be made no more than twice in a 12-month period. Your right to know request may include the following:

  • The categories of Personal Information we have collected about you

  • The categories of sources from which the Personal Information was collected

  • Our business or commercial purposes for collecting, selling, or sharing your Personal Information

  • The categories of third parties to which we disclosed your Personal Information

  • The categories of Personal Information we sold or shared about you and the categories of third parties to which each category of Personal Information was sold or shared

  • The categories of Personal Information we disclosed about you for a business purpose and the categories of persons to which it was disclosed

  • The specific pieces of Personal Information we have collected about you

  1. Right to Correct. You have the right to request that we correct inaccuracies in your Personal Data as permitted by law. Upon receipt of a verifiable request to correct inaccurate Personal Information, we will use commercially reasonable efforts to correct the information as you direct.

  2. Right to Delete/Erase. You have the right to request that we delete Personal Data that we have collected from or obtained about you and are currently maintaining. Please note, however, that we may have a legal basis for retaining Personal Information, despite your request.

  3. Right to Opt Out of Targeted Advertising. You have the right to request that we stop disclosures of your Personal Data for targeted advertising via cookies and tracking technologies by adjusting your cookie preferences through your browser or SSN.

  4. Right to Opt Out of Sales: You have the right to opt out of our Sales of your Personal Data, though our company does not sell your personal data.

  5. Right to Opt Out of Automated Processing. We do not engage in “automated processing” in a manner subject to “opt out” under Applicable State Privacy Laws. The right to opt out of automated processing is not applicable to your Personal Data that we process.

  6. Right to Opt Out of Profiling. We do not engage in “profiling” in a manner subject to “opt out” under Applicable State Privacy Laws. The right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects is not applicable to your Personal Data that we process.

  7. Right to restriction of processing: You have the right to request the limiting of our processing under limited circumstances.

  8. Right to Appeal. If you are unsatisfied with our actions related to the exercise of one of your privacy rights above, you may have the right to appeal our decision. Under the Applicable State Privacy Laws you have the right to exercise your privacy rights twice in a 12-month period.  You may do so by emailing us at info@barbeesbaubles.com 

  9. Right to object: You have the right to object to our processing of your personal data, as permitted by law, under limited circumstances.

  10. In order to exercise any of these rights, please contact us according to the “How to Contact Us” section below. Please note that the above rights are not absolute and we may be entitled to refuse requests, wholly or partly, where exceptions under the applicable law apply.

Removal from marketing list

We will send electronic communications to you if you have consented to these communications. With respect to other communications, it is in our legitimate interest to communicate to you about our products, services, promotions, offers, news, and events. We consider this use to be proportionate and will not be prejudicial or detrimental to you.
To be removed from our marketing list, please email us at  info@barbeesbaubles.com, or simply click the unsubscribe button found at the bottom of any of the emails that we send you. If you have set up “My Account,” you can also go to the “email preferences” section of your account and modify your subscription settings. Please allow us at least ten (10) business days from when the request was received to complete the removal, as some of our promotions may already be in process before you submit your request. 

Security

Barbee’s Baubles, LLC uses commercially reasonable measures to keep your personal data private and safe. We have enacted appropriate measures to maintain the security of personal data we collect. We only ever operate over private, secure networks with password protections in place that guard against unauthorized access to your data.
 
We use commercially reasonable security technology in transferring information to process your orders. All payment card transactions should take place in protected areas of our Websites, which are designed to reduce the risk of any loss, misuse or alteration of the information collected. When you begin the checkout process, you should move into such a protected area. Once you've entered, the page address (URL) should display “https” instead of “http.” 
 
Despite our best efforts, the transmission of data over the Internet cannot be guaranteed to be 100% secure. While we use commercially reasonable means to ensure the security of information you transmit to us, we cannot guarantee that such information will not be intercepted by third parties. We may, however, prosecute any unauthorized or fraudulent transactions to the fullest extent permitted by law.

Children's privacy

Our Websites are not intended for children. We do not intentionally collect any personal data from children under the age of sixteen, and will dispose of any such information if we become aware that it has been provided to us.

Changes to this privacy policy

Barbee’s Baubles, LLC may amend this Privacy Policy from time to time. If we change our Privacy Policy, we will post the updated Privacy Policy on this page with an updated date. Under certain circumstances (for example, in connection with certain material adverse changes to this Privacy Policy), we may also elect to notify you through additional means, such as posting a notice on the home page of our Websites or contacting you via email.
